Terms and conditions

These general terms and conditions apply to Stichting GoGroupNederland, established at De Grote Pekken 11, Veenendaal, registered with the Chamber of Commerce under number 94463484, email address info@gogroupnederland.nl and website www.gogroupnederland.nl.

These terms apply to every offer made by the entrepreneur and to every distance contract concluded between GoGroupNederland (hereinafter: “the entrepreneur”) and the consumer (hereinafter: “the participant”).

In these terms, the following definitions apply:

• Ancillary agreement: an agreement in which the consumer acquires products, digital content and/or services related to a distance contract and these are supplied by the entrepreneur or a third party.
• Reflection period: the period within which the consumer may exercise the right of withdrawal.
• Consumer: the natural person acting for purposes outside their trade, business, craft or profession.
• Day: calendar day.
• Digital content: data produced and supplied in digital form.
• Continuous agreement: an agreement that covers the regular supply of goods, services or digital content.
• Durable medium: any tool — including email — that enables the consumer or entrepreneur to store information addressed personally to them.
• Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the reflection period.
• Entrepreneur: the natural or legal person offering products, services or digital content to consumers at a distance.
• Distance contract: an agreement concluded under an organised system using only means of distance communication.
• Means of distance communication: a means by which an agreement can be concluded without the consumer and entrepreneur physically meeting.

These terms apply to every offer by GoGroupNederland and to every agreement concluded between GoGroupNederland and the consumer. The text of these terms is made available to the consumer before or during the conclusion of the agreement. For electronic agreements, a digital version is provided. In the event of conflicting terms, the provision most favourable to the consumer applies.

The offer contains a complete and accurate description of the products, services or digital content offered. Any mistakes do not bind the entrepreneur. If an offer has a limited validity period, this is clearly stated.

The agreement is concluded after acceptance of the offer and fulfilment of the associated conditions. In the case of electronic acceptance, GoGroupNederland confirms receipt without delay. Appropriate security measures are taken for payments by electronic means. Within legal limits, the entrepreneur may investigate the consumer’s creditworthiness.

The consumer may dissolve an agreement for the supply of products, services or digital content within 14 days without giving reasons. For products, the reflection period starts after receipt. For digital content or services, it starts the day after the contract is concluded. If no information about the right of withdrawal has been provided, a period of 12 months applies.

The consumer must handle the product carefully and use it only to the extent necessary for assessment. In the event of damage caused by use beyond these limits, the consumer is liable for depreciation.

Withdrawal takes place via a form or an unambiguous statement. The product must be returned within 14 days, in its original condition where possible. Return costs are borne by the consumer unless otherwise agreed. For digital content or services, compensation may be owed proportionally to the service already provided.

After notice of withdrawal, all payments are refunded within 14 days, including delivery costs, unless a more expensive delivery method was chosen. Refunds are made using the same payment method unless otherwise agreed.

• Services after full performance with the consumer’s consent
• Custom-made products
• Sealed goods that cannot be returned for hygiene reasons
• Digital content supplied without a physical carrier after consumer consent

Prices are not increased during the validity period of the offer, except in the event of VAT changes. Prices include VAT.

The entrepreneur guarantees that products/services comply with the agreement. Additional guarantees never limit statutory rights. In the event of course cancellations, refunds are granted in accordance with the cancellation conditions.

Delivery and performance are carried out with due care. GoGroupNederland will fulfil orders and services within the stated periods; in case of delay, the participant will be informed. If performance is unreasonably delayed, the participant may dissolve the agreement free of charge.

Contracts for an indefinite period may be terminated at any time subject to a notice period of no more than one month. Tacit renewal of a fixed period is only permitted under strict conditions. After one year, the consumer may always terminate the contract.

Payment within 14 days unless otherwise agreed. In the event of late payment, a reminder period of 14 days applies, after which interest and collection costs may be charged.

Complaints must be submitted within a reasonable time and be fully and clearly described. The consumer receives a response within 14 days. The entrepreneur has 4 weeks to resolve the complaint.

Dutch law applies to agreements. Disputes may be submitted to the competent court.

Deviating provisions may not disadvantage the consumer and are recorded in writing.

Information provided by participants (such as personal data, assignments or counselling questions) is treated confidentially. It is only shared with third parties when legally required or with consent.
